General terms and conditions for trainings at Valeria Künzli

1. These general terms and conditions apply to personal training at Valeria Künzli. As a rule, Valeria Künzli (training provider) will conclude a written customer dossier including a training agreement with the customer. The following provisions apply to trainings requested by customers. Individually deviating agreements take precedence provided they are agreed in writing in the customer file.

 

2. The training agreement is concluded between the customer and the training provider. Minor customers must have the training agreement signed by their legal guardian.

 

3. The training is generally carried out by the trainer specified in the customer dossier or agreed between the parties. The training provider can appoint another person as trainer in consultation with the customer.

 

4. The price for the training is listed under the “Prices” chapter in the customer dossier or on the website at https://www.valeriakuenzli.com/de/pricingandschedule.

 

5. The term of the training agreement ends with the last paid training unit and must be extended, if desired, by means of a new training agreement or a renewal form. If the paid training units are not redeemed, the right to training units expires two years after the conclusion of the training agreement or the renewal form, unless the customer submits a credibly justified and written request to extend the term of the training agreement. The invoice amount will not be refunded.

 

6. The respective invoice amount is due immediately after invoicing. The price includes training and coaching with the trainer. Any expenses and additional costs are to be paid by the customer.

 

7. The training provider reserves the right to postpone training dates with timely advance notice. The customer can cancel training dates that have already been agreed upon free of charge up to 24 hours before the start of the training. Training dates that are cancelled later will be charged in full or will be considered as attended. In the case of group training, postponements apply to all training participants unless otherwise agreed.

 

8. In the event of illness, accident or force majeure, an appointment can be rescheduled at short notice (i.e. with less than 24 hours' notice) without incurring any costs. The customer must be able to provide credible evidence of the reason for the short-term rescheduling.

 

9. Insurance is the responsibility of the customer. The customer confirms that he or she is adequately insured against the consequences of accidents and illness. Any liability for damages and consequential damages that the customer incurs as a result of an accident or illness during training is expressly excluded. The customer confirms that he or she is healthy enough to do sports.

 

10. The training provider assumes no liability for items stolen or lost before, during or after training sessions. The respective house or site rules apply at the training locations.11. The training provider expressly reserves the right to make any price adjustments and changes to the contract. The customer(s) will be notified of any such changes in writing in a timely manner.12. Changes of address must be communicated to the training provider.13. Swiss law applies. The exclusive place of jurisdiction for all disputes is the competent courts at the registered office or place of residence of the training provider.
